Legal Penalties of Shoplifting
As with any other theft crime in New York, the charges you will face for
shoplifting are determined by the value of the items stolen. The vast
majority of shoplifting cases are misdemeanor crimes, but stealing anything
valued at more than $1,000 brings the charges to a felony, for which there
are varying degrees as the value increases.
Shoplifting penalties in New York include:
Less than $1,000 in property: Class A misdemeanor; up to one year in prison & $1,000 fine
Between $1,000-$3,000: Class E felony; up to four years in prison & $5,000 fine
Between $3,000-$5,000: Class D felony; up to seven years in prison & $5,000 fine
Between $50,000-$1 million: Class C felony; up to 15 years in prison & $5,000 fine
More than $1 million: Class B felony; up to 25 years in prison & $5,000 fine
