Legal Penalties of Shoplifting

As with any other theft crime in New York, the charges you will face for shoplifting are determined by the value of the items stolen. The vast majority of shoplifting cases are misdemeanor crimes, but stealing anything valued at more than $1,000 brings the charges to a felony, for which there are varying degrees as the value increases.

Shoplifting penalties in New York include:

  • Less than $1,000 in property: Class A misdemeanor; up to one year in prison & $1,000 fine
  • Between $1,000-$3,000: Class E felony; up to four years in prison & $5,000 fine
  • Between $3,000-$5,000: Class D felony; up to seven years in prison & $5,000 fine
  • Between $50,000-$1 million: Class C felony; up to 15 years in prison & $5,000 fine
  • More than $1 million: Class B felony; up to 25 years in prison & $5,000 fine

The fine on all felony shoplifting charges is dependent on the value of the item stolen; your actual fine will be double your gain from the crime, up to the maximum listed value.
