New York's Robbery Statutes
N.Y. PEN. LAW § 160 describes the crime of robbery as "forcible stealing" in which the offender "uses or threatens the immediate use of physical force upon another person." All robbery charges are felonies, but the statute also provides three different degrees for this offense.
New York robbery statutes include:
- Third-degree robbery: The forcible stealing of property.
- Second-degree robbery: Robbery that occurs when there are multiple collaborators, a victim or bystander is physically harmed, or a firearm is displayed. Carjacking is also considered second-degree robbery.
- First-degree robbery: Robbery that occurs when serious injury is inflicted to bystanders or victims, the offender is armed with a deadly weapon, the use of a "dangerous instrument" is threatened, or a firearm is displayed.
