Legal Penalties of Shoplifting in New York
As with any other theft crime in New York, the charges you will face for shoplifting are determined by the value of the items stolen. The vast majority of shoplifting cases are misdemeanor crimes, and could result in a shoplifting fine, but stealing anything valued at more than $1,000 brings the charges to a felony, for which there are varying degrees as the value increases.
Shoplifting penalties in New York include:
- Less than $1,000 in property: Class A misdemeanor; up to one year in prison & $1,000 fine
- Between $1,000-$3,000: Class E felony; up to four years in prison & $5,000 fine
- Between $3,000-$5,000: Class D felony; up to seven years in prison & $5,000 fine
- Between $50,000-$1 million: Class C felony; up to 15 years in prison & $5,000 fine
- More than $1 million: Class B felony; up to 25 years in prison & $5,000 fine
